This Privacy Policy explains how Power Up Kids ("Power Up Kids," "we," "us," or "our") collects, uses, shares, and protects personal information when you visit powerupkids.com (the "Site"), join our waitlist, request our free guide, or contact us.

This policy covers the Site only. The Power Up Kids app has not launched yet. Before it launches, we will publish an updated policy that covers the app, including any information about children, and we will tell waitlist families about it.

1. Who This Site Is For

The Site is for parents and guardians. Power Up Kids makes fitness programs for kids and teens ages 10–18, but on this Site, signups, emails, and messages come from and go to parents. We ask kids and teens not to fill out any form on the Site. If your child wants to join, please sign up on their behalf.

2. Information We Collect

Information you give us

  • Waitlist signups: your name, your email address, and how many children are in your family (1, 2, 3, or 4+).
  • Free guide requests: your email address, and your name if you provide it.
  • Contact form: your name, email address, the topic you choose, your message, and anything else you decide to include.
  • Emails you send us: your email address and whatever you write.

Information collected automatically

  • Signup details: the date and time you signed up, the page you signed up on, and your place in the waitlist order.
  • Campaign details: if you arrive through a link that carries tracking tags (for example, a QR code in one of our printables, an Etsy listing, or a social media post), we record which campaign brought you to the Site.
  • Technical information: like most websites, our hosting provider automatically records technical details such as your IP address, browser type, device type, the pages you visit, the site that referred you, and the date and time of your visit. This is used to run and secure the Site.

Information we do not collect

We do not ask for or collect children's names, ages, photos, or health information on this Site. We do not collect payment information on this Site. We do not collect your precise location.

3. How We Use Information

We use personal information to:

  • Send you the free guide you requested.
  • Manage the waitlist, including your place in line and whether you qualify for Founding Family pricing.
  • Send launch updates, details about Founding Family pricing, and occasional emails about Power Up Kids programs, printables, and fitness tips for families. You can unsubscribe at any time.
  • Reply to your messages and questions.
  • Understand which pages, links, and campaigns bring families to Power Up Kids, so we can improve the Site. We look at this in summary form, not to build profiles of individuals.
  • Keep the Site working and secure, and prevent fraud, spam, and duplicate or automated signups.
  • Comply with the law and enforce our Terms of Service.

We do not use your personal information to make automated decisions that have legal or similarly significant effects on you.

4. How We Share Information

We do not sell your personal information. We do not share it for cross-context behavioral advertising, and we do not show ads.

We share personal information only in these situations:

  • Service providers: companies that help us run the Site, store data, and send email, such as our website hosting provider and email delivery service. They may use your information only to provide services to us.
  • Legal reasons: when required by law, court order, or government request, or when needed to protect the rights, property, or safety of Power Up Kids, our users, or others.
  • Business transfers: if Power Up Kids is involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that deal. We will make sure it remains protected by this policy or one at least as protective, and we will notify you.
  • With your permission: in any other case, only if you ask us to or agree to it.

5. Cookies and Similar Technologies

The Site uses only the cookies and browser storage needed for it to work, such as keeping the site secure and remembering where you are in a signup form. We do not use advertising cookies or third-party tracking pixels.

If we add analytics or any other non-essential cookies in the future, we will update this policy first and ask for your consent where the law requires it.

You can block or delete cookies in your browser settings, though some parts of the Site may not work properly without them.

Global Privacy Control: because we do not sell or share personal information, there is nothing to opt out of, but we treat a Global Privacy Control signal from your browser as a valid opt-out request wherever the law requires it.

6. Emails From Us

Every marketing email we send includes an unsubscribe link. If you unsubscribe, we may still send you messages you need, such as a reply to a question you asked.

Unsubscribing from emails does not remove you from the waitlist. If you want to leave the waitlist entirely, email hello@powerupkids.com. Please note that leaving the waitlist or asking us to delete your information removes your place in line and your Founding Family eligibility.

7. Children's Privacy

The Site is directed to parents, not children. We do not knowingly collect personal information from children under 13 on this Site. If we learn that we have collected personal information from a child under 13, we will delete it promptly. If you believe your child has sent us information, please email hello@powerupkids.com and we will delete it.

When the Power Up Kids app launches, parents will be able to add their children to a family account. Before that happens, we will publish a privacy notice that explains exactly what information the app collects about children, how it is used, and how parents can review or delete it, and we will obtain verifiable parental consent wherever the Children's Online Privacy Protection Act (COPPA) or other laws require it.

8. How Long We Keep Information

  • Waitlist and free guide information: until the app launches and for as long as needed to honor Founding Family pricing, or until you ask us to delete it, whichever comes first.
  • Contact form messages and emails: as long as needed to respond and keep a reasonable record of our conversation, generally no longer than 24 months.
  • Technical information: for the period set by our hosting provider's standard practices.

We may keep some information longer if the law requires it.

9. How We Protect Information

We use reasonable safeguards to protect personal information, including encrypted connections (HTTPS) and limiting access to the people who need it to run Power Up Kids. No website or method of storing or sending information is completely secure, so we cannot guarantee absolute security.

10. Your Privacy Rights

For everyone

You can ask us to:

  • Tell you what personal information we have about you and give you a copy.
  • Correct information that is wrong.
  • Delete your information.
  • Stop sending you marketing emails.

To make a request, email hello@powerupkids.com from the email address you used with us. We may ask you to confirm your request before acting on it. We will respond within 45 days. We will never treat you differently for exercising your privacy rights.

Residents of California and other U.S. states with privacy laws

Depending on where you live, you may have the right to know what personal information we collect, use, and disclose; to get a copy of it; to correct or delete it; to opt out of its sale, sharing, or use for targeted advertising (we do not do any of these); and to appeal if we deny your request. To appeal, reply to our decision or email hello@powerupkids.com with the subject line "Privacy Appeal." You may use an authorized agent to make a request for you; we may ask the agent for proof of your permission.

In the past 12 months, we have collected these categories of personal information:

  • Identifiers, such as your name, email address, and IP address.
  • Internet or other electronic activity, such as pages visited, the site that referred you, and campaign links you followed.
  • Other information you choose to share with us, such as the number of children in your family and the contents of your messages.

We collect this information from you, from your device, and from the links you follow to the Site. We use it for the purposes described in Section 3 and disclose it only to service providers for those purposes. We do not sell or share personal information, and we do not collect sensitive personal information on this Site.

11. Visitors Outside the United States

Power Up Kids is based in the United States, and your information is stored and processed in the United States. If you are visiting from the European Economic Area or the United Kingdom, we rely on the following legal bases: your consent (for marketing emails), steps you ask us to take (sending the free guide and replying to you), our legitimate interests (keeping the Site secure and understanding how it is used), and legal obligations. You have the right to access, correct, delete, restrict, or object to our use of your information, to receive a copy of it, to withdraw consent at any time, and to complain to your local data protection authority.

The Site links to other websites and services, such as Etsy, Instagram, Facebook, and Pinterest. We do not control them, and this policy does not apply to them. Please read their privacy policies before sharing information with them.

13. Changes to This Policy

We may update this policy from time to time, and we will update it before the Power Up Kids app launches. When we do, we will change the "Last updated" date at the top. If we make a significant change, we will let waitlist families know by email or post a notice on the Site before the change takes effect.
