Terms of Service

These Terms of Service ("Terms") are an agreement between you and Power Up Kids ("Power Up Kids," "we," "us," or "our"). They apply to your use of powerupkids.com (the "Site"), our waitlist, our free guide, and any other content or materials we offer on the Site (together, the "Services").

By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

The Power Up Kids app has not launched yet. When it does, it will come with its own membership terms, which we will share with waitlist families before launch.

IMPORTANT: Please read Section 5 (Health and Safety), Section 11 (Limitation of Liability), and Section 13 (Resolving Disputes) carefully. They affect your legal rights.

1. Who May Use the Services

You must be at least 18 years old (or the age of majority where you live) to sign up for the waitlist, request the free guide, or contact us. The Services are designed for parents and guardians.

Kids and teens may use our workouts and printable materials only with the permission and involvement of a parent or guardian. If you allow a child to use our content, you are responsible for that use and for supervising your child as appropriate for their age.

2. The Waitlist

  • Joining the waitlist is free and does not commit you to buy anything.
  • We are working toward launching the Power Up Kids app, but launch timing, features, and programs may change, and we may decide not to launch some or all of them.
  • Please give us accurate information when you sign up. One signup per family.
  • We may remove signups that are duplicates, use false information, or are created by bots or automated means.

3. Founding Family Pricing

  • Founding Family pricing is offered to the first 250 families on the waitlist, counted in the order their signups are recorded by our system.
  • Founding Families will receive a reduced rate for their first 12 months of paid membership. We will share the exact founding rate and how to claim it with waitlist families before launch.
  • After the first 12 months, standard membership pricing applies. We will tell you what that price is before it takes effect.
  • The offer is limited to one per family. It is tied to the email address used to sign up, cannot be transferred or sold, has no cash value, and cannot be combined with other offers unless we say otherwise.
  • If you leave the waitlist or ask us to delete your information, you lose your place in line and your Founding Family eligibility.
  • We may cancel Founding Family eligibility for signups that break these Terms, such as duplicate, false, or automated signups.

4. Free Guide and Printable Challenges

Our free guide and printable fitness challenges, including those sold through Etsy, are licensed to you, not sold. We give you a limited, personal, non-transferable license to download and print them for use within your own household.

You may not:

  • Resell, share, or distribute the files or printed copies.
  • Post them publicly, including on websites, social media, or file-sharing services.
  • Remove or change any copyright or brand notices.
  • Use them in schools, teams, clubs, camps, or businesses without our written permission. If you are a teacher or coach, email hello@powerupkids.com and we will be happy to talk.

Purchases made on Etsy are also subject to Etsy's terms and policies, including its policies on digital downloads.

5. Health and Safety

IMPORTANT: Power Up Kids provides general fitness content for informational and motivational purposes only. It is not medical advice and is not a substitute for advice from a doctor or other qualified health professional.

  • Check with your child's doctor before your child starts any exercise program, especially if your child has a health condition, is recovering from an injury or illness, or has not been active for a while.
  • Parents and guardians are responsible for deciding whether an activity is right for their child, for supervising as appropriate for their child's age and ability, and for making sure the exercise space is clear and safe.
  • Your child should stop any activity that causes pain, dizziness, shortness of breath, or discomfort, and tell an adult. In an emergency, call 911 or your local emergency number.

All physical activity carries some risk of injury. To the fullest extent allowed by law, you understand and accept these risks for yourself and on behalf of any child who uses our content with your permission.

6. Acceptable Use

When using the Services, you agree not to:

  • Give false information or sign up on someone else's behalf without their permission.
  • Use bots, scripts, or other automated means to sign up, submit forms, or collect content from the Site.
  • Interfere with, damage, or try to gain unauthorized access to the Site or its systems.
  • Copy, scrape, or republish the Site's content beyond what these Terms allow.
  • Send messages that are unlawful, harassing, abusive, or misleading.
  • Use the Services in any way that breaks the law.

7. Your Messages and Feedback

If you send us ideas, suggestions, or feedback, we may use them to improve Power Up Kids without paying you or owing you anything.

8. Our Content and Trademarks

The Site and everything on it, including text, workouts, images, graphics, logos, and the Power Up Kids name and brand, belong to Power Up Kids or are used with permission, and are protected by copyright, trademark, and other laws. Except as these Terms allow, you may not copy, change, distribute, or use any of it without our written permission.

9. Other Sites and Services

The Site links to other websites and services, such as Etsy, Instagram, Facebook, and Pinterest. We do not control them and are not responsible for their content, policies, or practices. Your use of them is governed by their own terms.

10. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent allowed by law, we make no warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Services will be uninterrupted or error-free, or that any particular fitness, health, or other result will be achieved.

11. Limitation of Liability

IMPORTANT: To the fullest extent allowed by law, Power Up Kids will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Services or our content, even if we have been told such damages were possible.

To the fullest extent allowed by law, our total liability for any claim related to the Services is limited to the greater of the amount you paid us directly in the 12 months before the claim, or US $50.

Some places do not allow certain of these limits, so some of them may not apply to you.

12. Indemnification

To the fullest extent allowed by law, you agree to defend and hold harmless Power Up Kids from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Services or your violation of these Terms.

13. Resolving Disputes

If you have a concern, please contact us first at hello@powerupkids.com. Most issues can be resolved quickly this way, and both of us agree to try to resolve any dispute informally for at least 30 days before starting a legal proceeding.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. Any legal proceeding related to these Terms or the Services will be brought in the state or federal courts located in Delaware, and both of us agree to those courts' jurisdiction. Either of us may bring a qualifying claim in small claims court instead.

14. Changes to the Services and These Terms

We may change, suspend, or stop any part of the Services at any time. We may also update these Terms from time to time. When we do, we will change the "Last updated" date at the top. If we make a significant change, we will let waitlist families know by email or post a notice on the Site before the change takes effect. If you keep using the Services after the change takes effect, you accept the updated Terms.

15. Ending Your Use

You may stop using the Services at any time. We may suspend or end your access to the Services, or remove you from the waitlist, if you break these Terms. Sections 4 through 13 continue to apply after your use ends.

16. General

  • These Terms and our Privacy Policy are the entire agreement between you and Power Up Kids about the Services.
  • If any part of these Terms cannot be enforced, the rest remains in effect.
  • If we do not enforce a part of these Terms right away, we have not given up our right to enforce it later.
  • You may not transfer your rights under these Terms. We may transfer ours as part of a merger, acquisition, or sale of assets.
  • Section headings are for convenience only and do not change the meaning of these Terms.
